Law360 — A California federal judge has rebuffed Johnson & Johnson’s bid to dismiss a suit alleging it violates state warning label and false advertising laws by selling asbestos-contaminated talcum powder products, writing the consumer products giant was “simply demanding more” detail than is necessary in a complaint.
In a three-paragraph minute order on Tuesday, U.S. District Judge George Wu denied J&J’s motion to dismiss the suit brought by seven women, who have opened a new front in the ongoing legal battles over J&J’s talc by arguing the alleged contamination of the products violates California’s False Advertising Law, Unfair Competition Law and Proposition 65. Prop 65 requires businesses of all kinds to put up cancer warnings if their operations or products might expose customers to known carcinogens.
