Oklahoma’s Asbestos Superfund Sites

Oklahoma is home to several EPA-designated Superfund sites with a history of asbestos exposure. Ongoing cleanup efforts aim to reduce risks and protect future generations from asbestos-related diseases.

Henley’s Sealants Incorporated in Oklahoma City processed asbestos-contaminated vermiculite, posing an active risk to employees and the surrounding community for decades. Although processing ceased in 1993, cleanup efforts occurred between 2010 and 2018. The risk of exposure lingered for years, affecting those who worked at or lived near the site.

Hudson Refinery in Cushing used asbestos in construction materials, leading to contamination of the soil, water, and sediment. A 2015 EPA review found no ongoing risks to public health, but workers who were exposed to asbestos during the refinery’s active years, 1922 to 1982, are still at risk of developing asbestos-related diseases.

Fourth Street Abandoned Refinery in Oklahoma City was added to the EPA’s Superfund list due to asbestos insulation and hazardous chemicals that contaminated the soil and groundwater. Cleanup efforts were completed in 2008, but the legacy of asbestos exposure continues to affect former workers and residents.

Oklahoma Refining Company in Cyril underwent EPA cleanup due to asbestos found in demolished buildings. Cleanup was completed in 2006, and environmental monitoring continued until 2017. Continued monitoring now ensures asbestos contamination does not pose a continued risk to public health.

Occupations at Risk for Asbestos Exposure

Agriculture Workers

Oklahoma’s economy relies heavily on agriculture, with farming and food processing prevalent throughout the state. Asbestos was used in farming equipment, mills, and food processing machinery due to its heat resistance, exposing countless workers. Facilities where workers are at risk for exposure include the following:

  • ACME Flour Mills
  • Oklahoma Agricultural and Mechanical College
Powerplant Workers

Oklahoma’s power industry has been a major source of asbestos exposure, with workers at risk due to insulation materials in boilers, turbines, and other high-temperature equipment. Notable facilities include the following:

  • Oklahoma Gas and Electric Company
  • Ponca City Municipal Electric System
  • Garson Light & Power Company
Military Personnel

Veterans who served in Oklahoma or were stationed at Oklahoma military bases have a high risk of asbestos exposure from construction materials, ships, aircraft, and vehicles. Notable military sites include the following:

  • Fort Still Army Base
  • Tinker Air Force Base
  • U.S. Naval Ammunition Depot
  • Veteran’s Hospital
Oil and Gas Workers

Oklahoma’s oil and gas industry, particularly in Tulsa, was once considered the “oil capital of the world.” As the state’s oil production boomed in the 20th century, oilfield workers were exposed to asbestos in equipment, machinery, and buildings. This exposure was prevalent throughout many oil refineries and drilling operations.

Options for Asbestos and Mesothelioma
Compensation in Oklahoma

The primary way for mesothelioma victims to seek compensation is by filing a lawsuit against the companies responsible for their exposure. A successful lawsuit can provide financial relief for medical bills, lost wages, and emotional distress. While many mesothelioma lawsuits in Oklahoma result in settlements, the Lanier Law Firm’s skilled Oklahoma mesothelioma lawyers are ready to take your case to trial, if necessary, to secure the maximum compensation possible.

Many asbestos companies filed for bankruptcy to shield themselves from mounting liability. The courts required them to establish asbestos trust funds to compensate victims. An estimated $30 billion is still available in these trust funds. Trust fund claims offer a faster and simpler way to obtain financial support and do not require a court appearance. Johns-Manville and Raybestos-Manhattan are two companies with active trust funds.

Veterans who were exposed to asbestos during military service may qualify for VA disability benefits. The VA rates mesothelioma as 100 percent disabling, allowing affected veterans to receive over $3,800 in monthly compensation, along with free medical care.

Asbestos Laws and Regulations in Oklahoma

Under Oklahoma’s statute of limitations, mesothelioma lawsuits must be filed within two years of the diagnosis date. Similarly, wrongful death lawsuits must be filed within two years of the death of a loved one from mesothelioma. These time limits are crucial in preserving your legal rights and ensuring that you receive compensation.

When a company acquires an asbestos company, 76 Okla. Stat. § 105 limits the purchasing company’s liability to asbestos exposure victims of the acquired company’s asbestos exposure, potentially reducing the compensation available. Consult an experienced Oklahoma mesothelioma attorney to understand how this law applies to your case.

Oklahoma also follows a two-disease rule in asbestos-related lawsuits. If a person develops a non-malignant asbestos disease and later develops an asbestos-related cancer like mesothelioma, they can file separate lawsuits for each condition. This rule provides additional legal avenues for those at risk of developing more serious asbestos-related diseases.
